These terms explain how O’Leary Development Group (“ODG”) scopes, confirms, changes, and documents dump-truck hauling and non-store material-delivery work.

What this covers
These terms cover only the dump-truck hauling and material-delivery work identified in an accepted written quote or service confirmation. ODG does not provide junk removal, dumpster rental, landscaping, excavation, demolition, or hazardous-material transport, and no other service is included unless ODG expressly accepts it. Online material orders are governed by our Material Terms of Sale.

Full policy text
1. Define the work before dispatch
Your written quote or confirmation identifies the customer, authorized contact, pickup and delivery locations, material, measurement or pricing basis, planned work, included trips or time where relevant, and any conditions affecting performance. Describe access, loading and unloading arrangements, site restrictions, and who is responsible for each task. A quote request alone is not authorization to start work.
2. Acceptance and authority
Confirm who can accept the quote, authorize dispatch, approve changes, and receive the work. ODG obtains acceptance through the method identified in the quote or confirmation. A site contact’s presence alone does not authorize a new price, extra work, or a change to your agreement.
3. Material and destination information
Describe the material accurately and disclose any characteristic or restriction relevant to safe and lawful handling. Do not tender material different from the accepted description, and do not direct delivery to a location without permission to receive it. Materials that require special licensing, testing, handling, or disposal arrangements need separate written confirmation. ODG does not accept regulated or hazardous loads.
4. Site readiness and safety
Arrange lawful entry, a suitable approach, an authorized unloading location, and any agreed loading support. Follow our Site Access & Delivery Readiness policy, and identify ground, overhead, traffic, utility, and other site hazards before dispatch. The driver decides whether to proceed with a requested vehicle movement. Unsafe instructions do not have to be followed.
5. Scheduling and changes
Your accepted confirmation identifies the scheduling process and any specific written commitments. A requested time is not guaranteed merely because it appears in an inquiry. Weather, access, equipment, and prior work may affect timing. Get written confirmation before changing the route, material, location, quantity, waiting requirements, or additional work.
6. Charges, records, and payment
Your accepted quote identifies the pricing basis, included services, applicable tax, payment requirements, and any separately approved charge schedule. Detention (waiting) time is charged at $135 per hour. A load returned or redispatched because of job-site conditions or improperly prepared access carries the charges described in Section 7. Minimum charges and fuel surcharges may apply at ODG’s discretion, and ODG will tell you the amount and the reason. Payment is due at delivery by cash, check, or credit card. Credit accounts, which require ODG’s written approval, are net 30 days from delivery, and balances not paid within 30 days incur interest at 18% APR. If an account goes unpaid, ODG may refer it to collections, and the customer is responsible for a $200 pre-lien fee, an $800 lien filing fee, and attorney and collection costs. Returned checks are subject to a $50 fee and may be referred for prosecution as theft of service, including through the Guadalupe County District Attorney’s Office. Keep your tickets, dispatch confirmations, delivery records, and approved changes. Report a billing discrepancy with enough detail to identify the affected trip or item.
7. Cancellation, unsuitable loads, and inability to proceed
Contact dispatch promptly if work must be cancelled or rescheduled, or if the load or site no longer matches the agreed conditions. ODG will explain the available options and any charge supported by your accepted agreement. An unsafe site or unsuitable load may require stopping work while dispatch and the customer determine a safe, authorized next step. If a load must be returned or redispatched because of job-site conditions or because the customer did not prepare site access properly, a starting fee of $250 applies, plus the additional cost of redispatching the load to another location or returning it to the plant. ODG and the customer will discuss and approve that additional amount before it is charged.
8. Concerns and other agreements
Report an apparent service, material, quantity, or placement concern promptly with the job reference and supporting records, and preserve relevant evidence where safe. A separately signed contract may address document priority or remedies. If documents conflict, ask for written clarification. Nothing in these terms waives rights that applicable law does not allow to be waived.
